A Russian citizen married to a Kazakhstani citizen may obtain a temporary residence permit (RVP) for family reunification. But a marriage certificate alone does not allow an unlimited stay: under Article 27 of the Law on Population Migration, this family route requires a marriage recognised in Kazakhstan that has lasted at least one year.
This guide is for an adult Russian citizen whose spouse is a Kazakhstani citizen permanently living in Kazakhstan. If the spouse is a Russian worker with an RVP, a different route applies: residence for an EAEU worker’s family. Check the inviting person’s exact status before applying.
The rules were checked on 16 September 2026. Below are the family RVP requirements, documents and steps. Searching for “Kazakhstan permanent residence through marriage” does not mean temporary and permanent residence use the same procedure.
What marriage provides—and what it does not
Article 27(3)(1) and (4)(1) provides for a family RVP for a Kazakhstani citizen’s spouse for up to three years, with a right to subsequent renewal. This is a maximum, not a promise that everyone receives exactly three years. An RVP cannot outlast the national passport—paragraph 10 of the Rules of Stay.
A temporary permit is not a permanent residence card and does not automatically become one after a year of marriage or several renewals. Permanent residence requires a separate application and eligibility assessment. Start preparing with the first permanent residence application guide.

If the marriage is recent or was registered abroad
For the family basis discussed here, the law says “at least one year”, not “three years” and not “immediately after the wedding”. Do not transfer citizenship waiting periods to an RVP. Cohabitation without a recognised marriage does not satisfy this condition.
If a year has not yet passed, check another suitable basis in advance. For example, genuine employment under a contract may allow a Russian citizen to obtain an employment RVP. Being potentially eligible for another basis does not mean it has already been granted: track your lawful stay separately until you receive the result.
For a marriage registered in Russia or another country, check the registration document, recognition of the marriage, name spellings and any name-change documents. This is preparation advice. The RVP rules require documents in a foreign language to be translated into Kazakh or Russian, with the translation’s accuracy certified by a notary; foreign official documents require legalisation unless a treaty or legislation provides an exception. Do not order an apostille automatically: first check whether a treaty applies to the issuing country and your particular document. Appendix 2, item 10 of the RVP Issuance Rules.
Documents for a family RVP
For submission through territorial police or the Government for Citizens State Corporation, Appendix 2, item 10 of the RVP Issuance Rules sets out the general package:
- The application form in Appendix 1 to the Rules.
- A copy of the foreign citizen’s identity document, with the original presented for comparison.
- A copy of medical insurance registered in the Saqtandyry system, with the original for comparison.
- Notarised consent for the foreign citizen to live at the property if the service recipient does not own the accommodation provided.
- A certificate confirming fingerprint registration. The service provider also checks fingerprint registration in the digital system.
The family reunification subtype additionally requires a document confirming the family relationship with a person permanently living in Kazakhstan. In this case, it is the marriage certificate; the spouse’s details must allow their identity and status to be checked.
The service recipient is the receiving person, not automatically the foreign spouse. Before applying, the couple should check the Kazakhstani citizen’s identity document, both individual identification numbers (IINs), the address and its registration code, and the property owner’s details. This is a preparation and data-checking list, not extra paid certificates beyond the state list. If the inviting spouse does not own the flat, marriage does not remove the stated accommodation-consent requirement.
Do not copy the permanent residence or business-immigrant RVP package. For example, a criminal-record certificate and medical form 028/u are not listed here as special documents for a family RVP. Steps before and after entry
- Before travelling, check the marriage date, passport validity, your spouse’s status and accommodation. If you are already in Kazakhstan, first establish the last day of your current lawful stay; getting married does not reset it.
- After entry, the receiving person must notify the internal affairs authorities within three working days. Keep the confirmation and check the details. Arrival notification does not replace a residence permit.
- Before applying, confirm the family basis, required details and chosen channel with the local migration service. The Rules provide for territorial police, the State Corporation and the eGov portal. Online submission requires the receiving person’s electronic digital signature; the list above is for in-person submission, and an online service does not mean documents will not be checked.
- When applying, obtain confirmation of acceptance. If the documents are not accepted, record the reason and missing items. Do not treat an unconfirmed submission as an issued RVP or an automatic extension of stay.
- After issue, check the name, basis, address and permit dates. Set a renewal reminder in advance. If the temporary address changes, the receiving person must notify internal affairs authorities within three working days—paragraph 10 of the Rules of Stay.
Before changing an existing employment RVP to a family basis, confirm the procedure and dates with the migration service. Do not end your employment or abandon the current basis on the assumption that marriage alone has already replaced the permit.
Processing time, cost and the right to work
The state RVP issuance service is free, with a processing time of one working day from submission of the required package. When applying through the State Corporation, the intake day is excluded; weekends, public holidays and online applications outside working hours are handled under the service’s operating rules. Arranging insurance, notarised documents and correcting errors are outside this processing period. RVP Issuance Rules, paragraphs 7–9 and Appendix 2, items 5, 8–9.
Translations, a notary, insurance and any chosen assistance are paid separately if needed. When comparing offers, ask providers to separate preparation costs from the intermediary’s fee: this list does not provide for a “state duty for a family RVP”.
The spouse of a Kazakhstani citizen who has arrived for family reunification may work on the same terms as Kazakhstani citizens—Article 29(2)(1). This does not remove the need to formalise employment, or mean that every relative or spouse of a foreign citizen has the same status. The family basis discussed here does not require an employment contract as evidence of marriage.
If the application is refused, you have overstayed or the marriage ends
Refusal to accept documents and refusal to issue a permit are different. An incomplete package or expired documents may lead to rejection at intake; inaccurate information or failure to meet requirements may lead to a reasoned service refusal. Obtain the written document and compare the reason with the checklist and Article 27. Correcting an error is different from satisfying an unmet marriage-duration condition. If your lawful stay has already ended, contact the territorial migration service immediately with your entry dates and documents. Do not treat marriage, an appointment or an appeal as automatic legalisation, or assume that leaving and re-entering will reset the restrictions. Resolving a violation and eligibility for continued residence are separate questions.
After divorce, invalidation of the marriage or the inviting spouse’s death, do not simply rely on the old RVP expiry date. Article 28(2) provides for an extension on application for up to six months when the circumstances supporting the family basis cease, provided the required funds are confirmed: at least the subsistence minimum set for the relevant financial year per family member per month. This is a conditional procedure, not six extra months automatically. Contact internal affairs authorities with supporting documents and check another residence basis or your departure deadline. What to prepare for an individual assessment
Make a short case summary: each spouse’s citizenship and status; the marriage registration date and country; passport expiry; last entry date and end of lawful stay; address and property owner; and type and expiry of any existing RVP. This helps identify the right basis before paying for certificates.
