Kazakhstan RVP refusal: what Russian citizens should do

Distinguish returned documents from a refusal, check records with your employer, reapply or prepare a complaint, and protect your stay deadline.

A refusal of a Kazakhstan temporary residence permit (RVP) does not always prevent a new application. First establish what happened: the documents were not accepted, the police refused the application after examining it, or a technical error meant that it was never registered. The next step depends on this distinction: complete the package, correct the information or appeal the decision.

This guide is for an adult Russian citizen applying for an RVP on the basis of an employment contract, and their hosting party. It does not replace the permanent-residence procedure: the rule allowing reapplication no earlier than one year later concerns refusal or annulment of permanent-residence permission, not automatically an RVP refusal.

The rules were checked on 15 September 2026. The main source is Ministry of Internal Affairs Rules No. 992, as amended by Order No. 454, published on 3 July and effective from 14 July 2026. Check your lawful-stay deadline alongside the reason for refusal, not after the correspondence ends.

Obtain the document first, not just a verbal explanation

If the package is incomplete or documents have expired, the police refuse to accept the application and issue a receipt under Appendix 4 to Rules No. 992. A refusal-to-accept receipt is also issued when applying through a public service centre (PSC). Points 6–7 provide for this; such a return must be distinguished from the outcome of an accepted application.

After examination, a refusal takes the form of a reasoned notification under Appendix 6: point 12 of the Rules refers to the grounds in item 11 of Appendix 2. Keep the document itself, the date you received it, the application number and the attachments. “It will not go through” or “the system cannot see it” is not enough to identify the legal reason.

For an online application, the hosting party should check its personal account: point 8 provides for an acceptance status and notification of the date and time of the result. A missing result, login error or unsigned draft does not by itself prove a reasoned refusal.

If the document concerns annulment of an RVP already issued, rather than refusal to issue one, that is a separate situation. Obtain the decision itself and check the stated ground and your stay deadline; the package-correction approach below cannot automatically be applied to annulment.

This is a practical decision aid, not statistics on the most common refusals. An incorrect entry is not the same as established forgery; its nature and consequences must be checked against the specific application materials.

Which refusal grounds the Rules list

Item 11 of Appendix 2 to Rules No. 992 contains four grounds common to the RVP subtypes:

  1. Established unreliability of the submitted documents or the information they contain.
  2. Failure of the service recipient, data or information to meet the Rules' requirements.
  3. A court decision that has entered into legal force depriving the service recipient of a special right connected with receiving the service.
  4. Absence of the service recipient's consent to access the necessary restricted-access personal data.

The service recipient in this procedure is the hosting party, not automatically the foreign worker: point 4 states this expressly. Reviewing a refusal therefore usually requires the hosting party's involvement. Permanent-residence refusal grounds must not be transferred to an employment RVP without checking their applicability.

Item 7 of Appendix 2 retains an inconsistent reference to item 9, which actually sets out working hours. To check the grounds, use point 12 of the Rules themselves and the titled list in item 11 of Appendix 2. If the notification contains only a general phrase, ask precisely which information and requirements did not match.

What the worker and employer should recheck before applying

For this employment-contract scenario, compare system records as well as uploaded copies. Under point 10 of the Rules, the police check border crossing in Berkut, the IIN, fingerprint-registration information, criminal-record and wanted-person data, unfulfilled obligations relating to previous violations, and whether the Unified System for Recording Employment Contracts (ESUTD) information matches the employer's details and the contract. A check does not mean that any record found automatically causes refusal: the decision needs an applicable ground.

The working checklist under item 10 of Appendix 2 for applying through the police or a PSC is:

  • the application form under Appendix 1;
  • a copy of the foreigner's identity document, with the original for comparison;
  • a copy of medical insurance registered in Saqtandyry, with the original for comparison;
  • notarised consent to residence if the hosting party does not own the accommodation provided;
  • a certificate of fingerprinting;
  • an employment contract registered in ESUTD, for the basis covered by this guide.

Point 5 provides for obtaining information from integrated digital systems: documents containing that information need not be submitted again. The Rules separately specify a system check of fingerprinting. First establish what is missing—a document or an accessible record—instead of ordering every certificate again. The list of employment bases includes other scenarios; it does not require you to collect all the permits, contracts and orders listed there at once.

The worker checks the spelling of their name, document number and IIN, and supplies valid documents and fingerprinting confirmation. The employer checks the ESUTD contract record and its own details. The hosting party arranges the accommodation document and application package; its electronic digital signature (EDS) is used for online submission. The worker's personal EDS is not a mandatory condition for every application method.

Can you apply again, and how long does it take?

Point 29 of the Rules establishes the one-year reapplication period specifically for permanent residence after a reasoned refusal or annulment of that permission. The RVP chapter contains no such general one-year wait. Once the cause has been resolved, you can prepare a new application if your basis and lawful-stay period remain valid. Uploading the documents again does not remove a court prohibition or another unresolved obstacle.

An RVP application is processed within one working day under point 9 and item 5 of Appendix 2. When applying through a PSC, the intake day is excluded from the service period. The state service is free; document corrections, a notary, insurance and a representative's assistance are separate expenses. One working day does not include the time your employer needs to correct a record or you need to prepare evidence.

A new application and a complaint serve different purposes: the first asks for the corrected package to be considered; the second challenges the earlier decision or action. Preserve evidence of the first submission before making corrections—it may be needed in a dispute.

How to prepare a complaint

Under point 30 of the Rules, submit the complaint to the service provider or official whose decision or action you challenge. Within three working days, they forward it with the administrative case file to the reviewing body unless they fully satisfy the demands themselves within that time. A complaint about a PSC employee's actions goes to the head of the State Corporation under point 33.

Under Article 92 of Kazakhstan's Administrative Procedural and Process-Related Code (APPC), the general filing deadline is no later than three months from when you learned of the act, action or inaction. If the act or its attachment lacks the legally required information on appeal methods, a period of up to six months applies to that act. A deadline missed for a valid reason may be restored on request; do not rely on this without evidence.

Article 93 requires a written complaint on paper or electronically. Prepare:

  1. The name of the body reviewing the complaint and the body or official whose decision is challenged.
  2. The applicant's details, IIN or BIN if available, postal address and actual residential or business address.
  3. Circumstances and evidence: the refusal notification, application number, original documents and confirmation of the disputed information.
  4. A specific demand and an explanation of why you consider the decision or action wrong.
  5. The date, signature or EDS and list of attachments; if a representative acts, proof of their authority.

Do not confuse review periods with the filing deadline: point 31 specifies five working days for a complaint received by the service provider and fifteen for the body assessing and monitoring state-service quality, counted from complaint registration. This is not a promise to issue an RVP within five days. Under point 34, court proceedings are available after pretrial appeal unless the law provides otherwise; check the court procedure and deadline separately for the subject of the dispute.

What to do if your stay is about to expire

A refusal creates no new period of permitted stay. Check your current RVP, entry dates and applicable basis under point 6 of Entry and Stay Rules No. 148. Do not treat the expected complaint response date as your new departure deadline.

Article 96 of the APPC provides for suspension of enforcement of the challenged act, subject to exceptions. But suspending enforcement of a refusal does not itself constitute an issued RVP or automatically extend an expired permit. Before your current period ends, ask the migration service on what basis you may remain and what action your particular situation requires.

If you have already overstayed, promptly contact the migration service with your hosting party, taking your passport, entry details, previous RVP and refusal documents. Article 517 of the Administrative Offences Code provides for liability for failure to leave; even up to three days is listed as a violation punishable by a warning, not a free extension. Consequences depend on duration, repetition and circumstances, so do not pay a randomly chosen fine instead of following the prescribed procedure.

The fifteen calendar days after a decision imposing liability for an earlier violation under point 6 of Rules No. 148 are a separate situation involving an exit notice. They are not fifteen days after any RVP refusal or a universal way to extend residence. Check the deadline and procedure for complying with the decision immediately.

What to bring to KLC

Prepare the notification or receipt, application number and date, entry and stay documents, contract and ESUTD information. This helps distinguish a correctable deficiency from a disputed decision and choose the next step before your stay expires.
